This privacy policy applies to information collected by Glosslab LLC (“Company”, “we” or “us”), via our www.Glosslab.com website and on our Glosslab mobile application (collectively, the “Site”). This document will outline our privacy practices, including how we collect and utilize information obtained, as they pertain to visitors to and users of our Site. It also describes the choices available to you regarding our use of your information and how you can opt-out of having your information collected. By using or accessing the Site, you consent to the terms of this privacy policy. If you do not agree to this privacy policy, you may not access or otherwise use the site.

GLOSSLAB, LLC (“GLOSSLAB”) is committed to ensuring the privacy of our customers’ personal information, and this privacy policy is designed to voluntarily comply with current privacy legislation.

INFORMATION COLLECTION

When you purchase something from our online store, as part of the buying and selling process we collect the personal information you give us such as your name, address, email address, telephone number, and credit or debit card number. When you browse our online store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Navigation: Even if you do not make a purchase on our site, we have the ability to track usage of our website, including what pages are visited, what products are viewed, and the third-party sites that led you to our site. This information is not used to track information about individuals, but is used at an aggregate level to customize our site, improve the online experience, and plan advertising and promotions.

Other information: There are times when you may provide information to us voluntarily. This occurs when you provide feedback to us through emails, return forms, letters, or telephone calls. We use this information to respond to your query, to keep track of customer feedback, and to improve our service to customers.

CONSENT

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we infer that you consent to our collecting it and using it for that specific reason only. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no. If after opting-in to our marketing list, you no longer wish to be contacted, you may withdraw your consent by clicking the “unsubscribe” option in the email message, informing us at privacy@glosslab.com.

SMS MARKETING

Glosslab may offer you the ability to receive SMS texts in connection with our services. If you opt-in to receive texts, you agree that Glosslab may send you reoccurring texts to the phone number you provide for transactional and marketing purposes in accordance with the terms of your opt-in. You can opt-out of receiving texts or calls to your phone number at any time by (i) for texts, texting "STOP" in response to any text you receive from us or contacting us at privacy@glosslab.com and specifying you want to opt-out of texts to your phone number. We may send you a text confirming any opt-out by you and any such opt-out is limited to the phone number used. Standard message, data, and other fees may be charged by your carrier, and carriers may deduct charges from pre-paid amounts or data allowances, for which you are responsible. Not all phones and/or carriers are supported. Contact your carrier for further details. Additional terms may apply as set out in the terms of your opt-in.

DISCLOSURE

Glosslab does not sell or otherwise share your personal information with anyone else, such as advertising agencies or marketing companies. Marketing information sent by GLOSSLAB may be sent by us as part of a cross-promotion or other collaboration with other companies or brands, but we do not disclose personal information to such companies or brands. GLOSSLAB will share your personal information internally with those staff members who need it to complete your purchase or carry out your instructions regarding the receipt of marketing information. We may send you marketing information by way of SMS text message, as well as other electronic means, and by mail. We may also communicate with you by SMS text message or other electronic means in order to notify you of transactional matters, such as booking confirmations and cancellations. Authorized GLOSSLAB service providers may also have access to this information in order to carry out their responsibilities directly connected with the processing of your purchases or handling of customer service issues. Outside of these activities, we will not disclose your personal information to any third party without your written consent unless required to do so by law. If you consent to receive text messages, Glosslab sends customers mobile marketing alerts by SMS message. You may receive SMS or MMS messages. Message and data rates may apply, check with your cellular or data carrier for information. Up to 6 promotional messages per month may be sent to you. Consent to get text messages is not required/not a condition for purchase of goods or services. You can opt out of receiving text messages by replying STOP to any of the text messages you have receive from Glosslab. Your opt-out request may generate a confirmation text.

BOOKING

Our online store is hosted by Boulevard Labs, Inc. (“Boulevard”). This company provides us with the online booking platform that allows us to make appointments for you. Boulevard utilizes Stripe Inc., (“Stripe”), or Braintree, a division of PayPal Inc. to deliver secure and reliable integrated payments. Your data, if stored, is stored through Boulevard's databases and software application. They store your data on a secure server behind a firewall. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our online store and its service providers.

SECURITY

We use encryption technology in our online store in an attempt to protect you against the loss, misuse or alteration of your personal information. When you fill out any forms during checkout, a secure server encrypts your information through the use of Secure Socket Layer (SSL) technology. To be sure you’re browsing securely during a transaction, check your web browser’s status or address bar for the closed padlock icon. This icon indicates that you are viewing a secure web page. Also, all browsers display an “s” after the “http” (https://) in the website address to indicate that you are in a secure environment. Your credit card information is encrypted using SSL and stored with encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

COOKIES

GLOSSLAB, as with many other websites, makes use of “cookies” to help deliver a better customer shopping experience. Cookies are alphanumerical identification elements that we transfer to the hard drive of your computer via your web browser. They enable our systems to recognize your browser and to offer you value-added services, such as saving the contents of your shopping basket and to deliver a more personalized shopping experience.

AGE OF CONSENT

By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence, and you have given us your consent to allow any minors under your care to use this site.

CHANGES TO PRIVACY POLICY

We reserve the right to modify this privacy policy at any time. Changes and clarifications will take effect immediately upon their posting on this website. If our company is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

ADDITIONAL PRIVACY POLICY PROVISIONS FOR CALIFORNIA RESIDENTS.

This PRIVACY NOTICE FOR CALIFORNIA RESIDENTS supplements the information contained in the Privacy Policy of Glosslab and applies solely to visitors, users, and others who reside in the State of California. We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and other California privacy laws. Any terms defined in the CCPA have the same meaning when used in this notice.

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“personal information”).     • personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.

We obtain the categories of personal information listed above from the following categories of sources:

  • Directly from our clients or their agents. For example, from documents that our clients provide to us related to the services for which they engage us.
  • Indirectly from our clients or their agents. For example, through information we collect from our clients in the course of providing services to them.
  • Directly and indirectly from activity on our website (www.glosslab.com). For example, from submissions through our website portal or website usage details collected automatically.
  • From third-parties that interact with us in connection with the services we perform. For example, from government agencies when we prepare readiness assessments for projects that receive government funding.

Use of Personal Information

We may use or disclose the personal information we collect for one or more of the following business purposes:

  • To fulfill or meet the reason for which the information is provided. For example, if you provide us with personal information in order for us to prepare a tax return, we will use that information to prepare the return and submit it to the applicable taxing authorities.
  • To provide you with information, products or services that you request from us.
  • To provide you with email alerts, event registrations and other notices concerning our products or services, or events or news, that may be of interest to you.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collections.
  • To improve our website and present its contents to you.
  • For testing, research, analysis and product development.
  • As necessary or appropriate to protect the rights, property or safety of us, our clients or others.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Sharing Personal Information

We may disclose your personal information to a third party for a business purpose.  When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.

In the preceding twelve (12) months, we have disclosed the following categories of personal information for a business purpose:

Category A:             Identifiers.
Category B:             California Customer Records personal information categories.
Category C:             Protected classification characteristics under California or federal law.
Category I:              Professional or employment-related information.

We disclose your personal information for a business purpose to the following categories of third parties:

  • Our affiliates.
  • Service providers.
  • Third parties to whom you or your agents authorize us to disclose your personal information in connection with products or services we provide to you.

In the preceding twelve (12) months, we have not sold any personal information.

Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
    • sales, identifying the personal information categories that each category of recipient purchased; and
    • disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request by emailing us at privacy@glosslab.com. 

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  Making a verifiable consumer request does not require you to create an account with us.  We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 45 days of its receipt.  If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.  If you have an account with us, we will deliver our written response to that account.  If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.  Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt.  The response we provide will also explain the reasons we cannot comply with a request, if applicable.  For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.  If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Changes to Our Privacy Notice

We reserve the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will notify you by email or through a notice on our website homepage.

Additional Disclosures for Nevada Residents

Nevada consumers may submit requests directing a business not to sell certain kinds of personal information that the business has collected or will collect about the consumer. A sale under Nevada law is the exchange of personal information for monetary consideration by the business to a third party for the third party to license or sell the personal information to other third parties. We use reasonable processes to ensure compliance with this privacy policy and periodically verify that the policy is accurate. To opt-out of any future promotional messages from us, if applicable, you should send an unsubscribe request to us at privacy@glosslab.com. We will process your request within a reasonable time after receipt. However, we are not responsible for removing your PII from the lists of any third party who has previously been provided with your information in accordance with this Privacy Policy or your consent. We encourage you to raise any concerns using the contact information provided below, and we will investigate and attempt to resolve any complaints and disputes regarding use and disclosure of information. You may also request access to your PII (if you have provided PII to us through the Site) and information about our collection, use and disclosure of that information by using the contact information provided below. Subject to certain exceptions prescribed by law, you will be given reasonable access to your personal information, entitlement to challenge the accuracy and completeness of the information, and the ability to have it amended as is appropriate.
